Also depends on under which law the litigant is seeking a divorce. As far as an uncontested divorce or mutual divorce under the Hindu Marriage Act is concerned, at least 1 year of separation is required before filing the joint motion; after that 6 to 18 months of cooling off period. At the end of this cooling off period at the discretion of the Court, second motion is filed. After 2-3 weeks of paperwork, divorce decree is granted. Please note: 6 months is a mandatory cooling off period; however same can me waived off under certain conditions.
